These Terms & Conditions ("Terms") govern your access to and use of all websites, platforms, applications, and services operated by SC The Boiling Room SRL ("Company", "we", "us", "our"), including but not limited to SwingersPlay, KinkDome, and all affiliated or interconnected platforms (collectively, the "Services").

By accessing or using any part of the Services, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use.

1. Nature of the Services

The Services are interactive online platforms that allow adult users to create profiles, upload content, communicate, and interact with other users.

The Company:

• does not verify user identities or information
• does not guarantee accuracy, truthfulness, legality, or authenticity of any content or user
• does not arrange, facilitate, or supervise real-world meetings or interactions

2. Eligibility & Adult Content

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Services.

The Services may contain sexually explicit adult content. By accessing the Services, you confirm that:

• such content is legal in your jurisdiction
• you will not permit minors to access the Services

3. User-Generated Content — Safe Harbor

• Users are solely and fully responsible for all content they upload, post, transmit, or share.
• The Company is an interactive computer service provider and is not the publisher or speaker of user-generated content, including under 47 U.S.C. §230 and equivalent laws.
• The Company has no obligation to monitor, review, or moderate user content.

4. Global Network Database Disclosure

By creating an account, you explicitly acknowledge and consent that:

• your profile, content, and data may be stored, indexed, processed, and displayed across a global network of Company-operated platforms
• data may be transferred internationally

This consent is irrevocable to the maximum extent permitted by law.

5. User Interactions & Assumption of Risk

All interactions with other users—online or offline—occur entirely at your own risk.

The Company:

• does not conduct background checks
• does not verify user intentions
• assumes no responsibility for user conduct

You release and waive all claims, known or unknown, arising from interactions with other users (including California Civil Code §1542 where applicable).

6. Content Control & Account Termination

The Company reserves the absolute and unrestricted right, but not the obligation, to:

• remove, edit, restrict, or delete any content
• suspend or terminate any account
• take any action or no action at all

Such actions may occur with or without notice, for any reason or no reason.

7. Data Collection & Disclosure

You consent to the collection, storage, and processing of:

• device identifiers
• IP addresses
• behavioral and usage data
• communications metadata
• technical and analytical information

Data may be shared with:

• affiliated platforms
• service providers
• advertisers (where legally permitted)
• law enforcement or governmental authorities worldwide

8. Security & Data Breach Disclaimer

While the Company implements reasonable technical and organizational safeguards, no system is completely secure.

The Company shall not be liable for hacking, unauthorized access, data breaches, or data loss, except where liability cannot be excluded by law.

9. Paid Services & Subscriptions

Subscriptions provide only a limited, revocable license to access the Services.

No subscription:

• guarantees service availability
• creates ownership rights
• guarantees continuity

Lifetime subscriptions do not guarantee perpetual access.

No refunds are provided unless required by law.

10. Marketing & Content License

You grant the Company a worldwide, perpetual, royalty-free license to use uploaded content for platform operation, promotion, and marketing, subject to applicable law.

Additional consent may be required in certain jurisdictions.

11. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

• personal injury
• emotional distress
• financial loss
• reputational harm
• data loss
• user misconduct
• criminal acts of other users

Your sole remedy is to discontinue use of the Services.

13. Indemnification

You agree to indemnify and hold harmless the Company, its owners, employees, affiliates, and partners from any claims, damages, losses, or expenses arising from:

• your content
• your conduct
• your violation of law or third-party rights

14. Dispute Resolution & Class Action Waiver

Any dispute shall be resolved individually through binding arbitration, with no class actions permitted, except where prohibited by law.

15. Governing Law

These Terms are governed by Romanian law, subject to mandatory local protections that cannot be waived.

16. Modifications & Termination

The Company may:

• modify these Terms at any time
• discontinue Services at any time
• sell platforms, databases, or assets

Continued use constitutes acceptance of modifications.

17. Severability & Survival

If any provision is found unenforceable, the remaining provisions remain in full force and effect.
